Terms of service
Last updated 3 November 2026.
These terms are between Mark Forde, trading as FairRenew ("we", "FairRenew") and the business that signs up ("you").
1. What FairRenew does
FairRenew reads subscription data from your Stripe account, works out when notices are due using rules we publish, sends those notices by email to your customers on your behalf, hosts a cancellation page for your customers, and keeps a log of what was sent.
2. Not legal advice
FairRenew sends notices. It does not give legal advice. The rules it applies are our reading of the Digital Markets, Competition and Consumers Act 2024 and the draft regulations and guidance, which may change. You are responsible for your own compliance, including your sign-up page, your terms, your refunds, returns of goods and anything we do not send. Using FairRenew does not guarantee that you comply with the law.
3. Your responsibilities
- You confirm the subscriptions you connect are consumer contracts you are entitled to send notices about, that none of the excluded types apply, and you tell us about any exclusions.
- You keep your business name, address, support email and settings accurate. Notices use them.
- You check the preview before switching on sending, and you act on cancellations, refunds and problems we tell you about.
- You make refunds yourself. We never move money.
- You record cancellations you receive by email, phone or post in your dashboard, so we can confirm them.
4. Stripe access
You give us a restricted Stripe key. We store it encrypted and use it only to provide the service. You can remove it at any time from your dashboard or by deleting it in Stripe. Notices are only sent with a live-mode key; a test-mode key gives the preview only.
5. Sending and delivery
We aim to send every notice inside the window shown in your preview. Email delivery can fail for reasons outside our control (for example a full or closed mailbox). We record delivery results we receive in your audit log. If our service is unavailable, notices due in that time are sent when it returns, and marked as late; any we could not send in time are shown on your dashboard and emailed to you.
To protect every customer's notices, we limit sending: up to 100 notices in any 24 hours during the free trial, and we may pause an account that sends far more than its size suggests while we check. Notices held back stay due and go out on later runs. Cancellation confirmations are never held back. Text you enter is sent as plain text and may only mention your own website.
6. Fees, free trial and grace period
Plans and prices are shown on our website and exclude VAT. Payment is taken by Stripe. If you sign up before 1 January 2027, your free trial runs until the end of 14 January 2027; otherwise it lasts 14 days. The free trial includes live sending.
Grace period. If your free trial ends, your plan stops (for example a failed payment) or you go over your plan's subscriber limit, we do not stop straight away. We keep sending the notices the law requires to your existing subscribers for 14 days, and we warn you by email and on your dashboard before and during that time. After those 14 days we stop sending reminders and cooling-off notices until you choose a plan; cancellation confirmations continue. You can cancel your plan at any time; it ends at the end of the period you have paid for.
7. Data protection
For your customers' personal data, you are the controller and we are your processor. Our privacy policy sets out our processing terms, sub-processors and security measures, and forms part of these terms.
8. Records
We keep your audit log for as long as you have an account, because customers can bring claims up to 12 months after a missed notice. The log is held by us; you can download a copy at any time and we recommend you do so regularly. When you close your account you can download it first; we delete it 30 days after closure unless you ask us to keep it.
9. Liability
Nothing in these terms limits liability that cannot be limited by law. Otherwise, our total liability in any 12 months is limited to the fees you paid us in that period, and we are not liable for indirect losses, or for fines, refunds or claims arising from your own obligations to your customers.
10. Ending
You can stop at any time. We may suspend sending if fees are unpaid, after the grace period above, with notice to you by email. We may suspend an account immediately if it is used to send anything other than genuine notices to its own customers.
11. Law
These terms are governed by the law of England and Wales.
